As part of a €3 billion tender for the public contract to replace more than 600 trainsets, the National Railway Company of Belgium (NMBS/SNCB) announced a preference for the Basque company CAF, a BDS movement priority target.
CAF is operating in Israel’s illegal colonial settlements in the occupied Palestinian territory through its expansion of the Jerusalem Light Rail (JLR) in violation of international law.
Granting the contract to CAF would make NMBS/SNCB complicit with Israel’s unlawful occupation, racial segregation, and apartheid regime.
CAF is operating and extending the so-called Jerusalem Light Rail’s “Red Line” and is building the new “Green Line.” Both lines connect illegal Israeli settlements in the occupied Palestinian territory with West Jerusalem.
The JLR network is contingent on the expropriation of Palestinian land and the further territorial fragmentation of the city’s Palestinian neighbourhoods.
In July 2024, the International Court of Justice (ICJ) ruled that Israel’s entire occupation of Gaza, and the West Bank, including East Jerusalem, is illegal and that it’s guilty of apartheid–a crime against humanity.
NMBS/SNCB has an ethical responsibility and a legal obligation to exclude from contracts companies and institutions that are implicated in recognising, aiding or assisting this illegal system of oppression.
NMBS/SNCB must adopt a human rights procurement policy, stipulating that it will not invest in or contract with companies complicit in grave human rights violations, especially atrocity crimes, anywhere.
NMBS/SNCB is state-owned. Granting CAF this large contract is not only immoral and illegal, but it’s also hypocritical. In September 2024, Belgium was in the global majority that voted at the UN General Assembly to adopt the ICJ ruling regarding Israel’s illegal occupation. The ruling affirms Belgium’s legal obligation to cease any direct or indirect complicity in maintaining Israel’s illegal occupation and apartheid.
As Israel escalates its genocide against 2.3M Palestinians in Gaza, shattering the recent already fragile ceasefire, CAF must be held accountable for its persistent complicity in Israel’s war crimes.
The Palestinian BDS National Committee, the largest coalition in Palestinian society that is leading the global Boycott, Divestment and Sanctions (BDS) movement, calls on Belgian civil society organisations, grassroots groups, trade unions and political parties to pressure the Belgian government and its state-owned Railway company NMBS/SNCB to deny CAF this contract and commit to adopt a human rights procurement policy in order to defend the rule of international law at a time when it is being severely eroded.

CAF opère dans les colonies illégales israéliennes en territoire palestinien occupé, notamment à travers l'extension du tramway de Jérusalem (Jerusalem Light Rail, JLR), en violation du droit international.
Accorder ce contrat à CAF rendrait la SNCB complice de l'occupation illégale, de la ségrégation raciale et du régime d'apartheid d'Israël.
CAF exploite et travaille à l'expansion de la "ligne rouge" du JLR et construit la nouvelle "ligne verte". Ces deux lignes relient les colonies israéliennes illégales en territoire palestinien occupé à Jérusalem-Ouest.
Le réseau du JLR repose sur l'expropriation des terres palestiniennes et la fragmentation territoriale accrue des quartiers palestiniens de la ville.
En juillet 2024, la Cour internationale de justice (CIJ) a statué que l'occupation israélienne de Gaza, de la Cisjordanie, y compris Jérusalem-Est, est illégale et qu'Israël est coupable d'apartheid – un crime contre l'humanité.
La SNCB a une responsabilité éthique et une obligation légale d'exclure de ses contrats les entreprises et institutions impliquées dans la reconnaissance, l'aide ou l'assistance à ce système illégal d'oppression.
La SNCB doit adopter une politique d'achat respectueuse des droits humains, stipulant qu'elle n'investira pas et ne fera pas de contrats avec des entreprises complices de violations graves des droits humains, en particulier de crimes contre l’humanité, où que ce soit.
La SNCB est une entreprise publique. Accorder ce contrat à CAF est non seulement immoral et illégal, mais aussi hypocrite. En septembre 2024, la Belgique faisait partie de la majorité mondiale qui a voté à l'Assemblée générale des Nations unies pour l'adoption de l'avis de la CIJ concernant l'occupation illégale d'Israël. Cet avis confirme l'obligation légale de la Belgique de cesser toute complicité directe ou indirecte dans le maintien de l'occupation illégale et de le régime d’apartheid israélien.
Alors qu'Israël intensifie son génocide contre 2,3 millions de Palestiniens et Palestiniennes à Gaza, brisant la récente trêve déjà fragile, CAF doit être tenue responsable de sa complicité persistante dans les crimes de guerre d'Israël.
Le Comité national palestinien au BDS, la plus grande coalition de la société palestinienne qui dirige le mouvement mondial de Boycott, Désinvestissement et Sanctions (BDS), appelle les organisations de la société civile belge, les collectifs de la base, les syndicats et les partis politiques à faire pression sur le gouvernement belge et sa société ferroviaire publique, la SNCB, pour qu'elle refuse ce contrat à CAF et s'engage à adopter une politique d'achat respectueuse des droits humains afin de défendre le droit international à un moment où celui-ci est gravement menacé.

Als onderdeel van een aanbesteding van 3 miljard euro voor het openbare contract ter vervanging van meer dan 600 treinen, kondigde de Nationale Maatschappij der Belgische Spoorwegen (NMBS) de voorkeur aan voor CAF, een prioritair doelwit van de BDS beweging.
CAF opereert in de illegale koloniale nederzettingen van Israël in het bezette Palestijnse gebied door haar tramlijn (Jerusalem Light Rail, JLR) uit te breiden, wat in strijd is met het internationale recht.

In juli 2024 oordeelde het Internationaal Gerechtshof (ICJ) dat de gehele bezetting van Gaza en de Westelijke Jordaanoever, inclusief Oost-Jeruzalem, door Israël illegaal is en dat Israël schuldig is aan apartheid - een misdaad tegen de menselijkheid.
De NMBS heeft een ethische verantwoordelijkheid en een wettelijke verplichting om bedrijven en instellingen die betrokken zijn bij het erkennen, ondersteunen of assisteren van dit illegale onderdrukkingssysteem uit aanbestedingen uit te sluiten.
De NMBS moet een aankoopbeleid voor mensenrechten aannemen, waarin wordt vastgesteld dat het niet zal investeren in, of contracten zal afsluiten met bedrijven die medeplichtig zijn aan ernstige mensenrechtenschendingen, met name misdaden tegen de menselijkheid, overal ter wereld.
De NMBS is een overheidsbedrijf. Het toekennen van dit grote contract aan CAF is niet alleen immoreel en illegaal, maar ook hypocriet. In september 2024 maakte België deel uit van de meerderheid van landen die in de Algemene Vergadering van de VN heeft gestemd om de uitspraak van het ICJ over de illegale bezetting door Israël goed te keuren. De uitspraak bevestigt de wettelijke verplichting van België om elke directe of indirecte medeplichtigheid aan het in stand houden van de illegale bezetting en apartheid van Israël te beëindigen.
Terwijl Israël zijn genocide tegen 2,3 miljoen Palestijnen in Gaza opvoert en het recent het fragiele staakt-het-vuren verbreekt, moet CAF verantwoordelijk worden gehouden voor zijn voortdurende medeplichtigheid aan de oorlogsmisdaden van Israël.
Het Palestijnse BDS Nationale Comité, de grootste coalitie in de Palestijnse samenleving die de wereldwijde Boycot, Desinvestering en Sancties (BDS) beweging leidt, roept Belgische maatschappelijke organisaties, collectieven, vakbonden en politieke partijen op om druk uit te oefenen op de Belgische regering en het overheidsbedrijf NMBS om dit contract aan CAF te weigeren en zich in te zetten voor een publiek aanbestedingsbeleid dat de mensenrechten respecteert om de internationale rechtsorde te verdedigen op een moment dat deze ernstig wordt ondermijnd.
